The transfer of the National DNA Data Bank was authorized

The National Court in Administrative Matters No. 1 dismissed the request intending to prevent the transfer of the National Genetic Data Bank (BNDG) to its new headquarters at Av Cordoba 831.

After the Ministry of Science, Technology and Productive Innovation presented a report requested by the Federal Court in Administrative Matters No. 1 about the conditions for the move and transfer of operations of the National DNA Data Bank (BNDG), the Federal Judge in Administrative Matters, Ernesto Luis Marinelli, ordered the “dismissal of the interim measure requested, as its main purpose was to prevent the move of the new offices”, so he dismissed such interim measured requested last September. This Court order allows moving this entity away from the Durand Hospital to the facilities of the Ministry of Science, located at Av Cordoba 831 , as provided by Act N° 26548.

Dr. Barañao expressed he was satisfied with this Court order and said it “recognises the Ministry’s intent to set up a hierarchy and grant more important safety measures to this institution that has played a key role in the process of identification of relatives of persons who were missing during the military government".

In this Court order, the judge also expressed that “the claimant could not submit sufficient evidence as to the existence of arrangements to hide from the public a deviation from the legal purpose and functions of the BNDG, nor a hazardous situation with respect to the material or samples, documents or records to be transferred", as defendant is committed to implement safety and transparent measures for the BNDG transfer", and the Ministry is working in this process and has prepared a transfer agreement.

Dr. Barañao expressed he was satisfied with this Court order and said it “recognises the Ministry’s intent to set up a hierarchy and grant more important safety measures to this institution that has played a key role in the process of identification of relatives of persons who were missing during the military government". He also asserted that "firstly, the Ministry has always intended to obtain full jurisdiction over the Bank, as stated in Act No. 26,548, and secondly it has intended to grant that institution such conditions as those of similar international institutions for its operations, as to its equipment and the working conditions of its staff and the service granted to families".

In connection with Dr. Marinelli’s requirement of performing a transfer of all the Bank samples, the Minister asserted that this question “had been previously defined by the scientific coordinators in charge of this process, doctors Héctor Targovnik and Víctor Penchaszadeh, considering the convenience of granting all the samples the same guarantee in connection with their safety and quality of security.” Finally, Dr. Barañao announced that "the Ministry has completed a call for the formation of an international jury to appoint the Bank authorities and, soon, a call for applications for the respective positions will start".
